Richard T. Moore (D-Uxbridge), Senate Chairman of the Legislature’s Joint Committee on Health Care and the Special Senate Committee on National Health Reform, writes that the latest target of anti-government advocates is Senate Bill No. 2028, a pandemic and emergency preparedness plan that gives officials authority to quarantine individuals if necessary:

This summer, vividly and loudly dominating our TV news and print media, America witnessed a raucous display of distrust of our own elected government in the health care town hall meetings. The President and Congress are seeking to expand access to affordable health insurance, and therefore health care, to all Americans. But some of our fellow citizens, skeptical of anything government does, demonized those who tried to explain the proposals before Congress and shouted down explanations rather than engage in a reasonable discussion of the problems and possible solutions.

The anger over health reform efforts by the national government to help Americans expand their right to life, health and happiness has, apparently spilled over to Massachusetts in the form of anger at efforts under discussion in the state government to protect the rights of all citizens during a time of public health emergency. For more than a century, government has had extraordinary powers to respond to an epidemic, and it has generally exercised those powers responsibly. However, legislation aimed at modernizing and refining those powers to preserve individual liberty while protecting everyone from epidemic has been seen by some as more “big brother” government.

“Life, liberty, and the pursuit of happiness” is one of the most famous phrases in America’s Declaration of Independence. These three aspects, which are listed among the inalienable rights that we all enjoy, are based on the writings of English philosopher John Locke. Locke expressed the fundamental belief that “no one ought to harm another in his life, health, liberty, or possessions.”

However, just saying the words doesn’t guarantee that we have, or can keep, these rights. Each of us must stand up for our rights and the rights of others. In our democracy, we expect our government to preserve, protect, and defend those rights.

Around September 11 each year since 2001, we remember events when a small group of terrorists tried to take those rights away. In fact, they did deprive several thousand innocent civilians and dedicated emergency responders of their lives, health, liberty and possessions. A few months later, one or more individuals tried, once again, to deprive Americans of their inalienable rights when letters containing the deadly Anthrax was mailed to media and government offices. Some postal workers who handled those letters became ill and died.

Most of us believe that our government has, or should have, the authority and the responsibility to take necessary actions to protect us from those who are intent on harming or killing us or depriving us of our liberties. We also expect that our government will take steps to protect us and our loved ones from the spread of deadly viruses or the consequences of natural disasters, even if protecting all of us might temporarily limit our individual freedoms. After all, while we all have basic rights as Americans, most of us understand that we also have a fundamental responsibility not to harm anyone by our individual actions or decisions.

We have conferred on our government the resources and the authority to protect us when society is threatened as with the threat of a major disease epidemic on the magnitude of the Great Influenza Epidemic. That epidemic killed thousands of Massachusetts residents in 1918. In recent months, there have been numerous reported cases of a virus called H1N1, or Swine Flu, that have renewed health concerns and we expect our government to offer protection.

Although Massachusetts, and other state governments, has the authority to require us to be vaccinated, no one has proposed that vaccination for any flu be mandatory. Certainly, there is no H1N1 vaccine currently approved for use, but even when a vaccine becomes available no one is planning to require that we all get vaccinated. Nevertheless, under existing law – upheld as constitutional by the U.S. Supreme Court in the landmark case of Jacobson v. Massachusetts [197 U.S. 11 (1905), mandatory vaccination is deemed “a legitimate exercise of the state’s police power to protect the public health and safety of its citizens.” The state has the authority to vaccinate, but has stated that it will not mandate such action in the case of H1N1.

In an effort to protect all of us from any arbitrary abuse of this authority, legislators and public health experts began to review state public health emergency laws in 2001 following the Anthrax experience. Leading legal and public health scholars from around the nation worked under the guidance of the Georgetown Law School Center for Public Health Law along with public health experts from Johns Hopkins University Medical School to draft a model act to guide state efforts to update public health laws that, in most cases, had not been reformed since the 1918 Influenza Epidemic. To date 45 states have introduced bills in their legislatures based in whole or in part on the Model State Emergency Health Powers Act, and 38 states have passed those bills, including many Northeast states. The Act has become one of the most widely used models for public health legal reform ever.

In Massachusetts, the Department of Public Health, the Massachusetts Medical Society, the Massachusetts Hospital Association, the Massachusetts Public Health Association, and others have been working with legislators for the past eight years to craft a bill to update public health emergency preparedness statutes in light of the views of today’s society. As the bill has been developed, it has had several well-attended public hearings and formal debate in both branches of the Legislature. It has been improved with each responsible criticism. The bill under consideration attempts to narrow the current broad state public health authority to protect individual liberties while protecting the rights of all citizens in the spirit that John Locke espoused that “no one ought to harm another in his life, health, liberty, or possessions.”

Contrary to what some have been saying in the media and in blogs, the bill – Senate Bill No. 2028 – does NOT mandate vaccination. It does say that if public health officials believe that vaccination is the recommended prevention measure, and someone does not want to be vaccinated to protect themselves and those around them, the public health officials MAY order that they be isolated or quarantined. While some states ordered quarantines last spring because of H1N1 virus, Massachusetts health officials did not. In fact, throughout the last century, public health officials have used their emergency powers sparingly and responsibly.

The “Pandemic Public Health Emergency Preparedness” bill would allow arrest or entry into property for violations of quarantine, but only if there is “probable cause.” This is a high standard defined by numerous court decisions over the years, and those officials who abuse or ignore that standard get into serious trouble. The bill actually sets a framework of standards in place to narrow the sweeping emergency powers that are already in place so that individuals have legal protection from abuse by any government official. While some who distrust any government are opposing passage of this bill, if they fully understood its purpose and studied the bill in the context of existing law, they ought to be calling for its swift passage rather than protesting and demonizing those who advocate for the law.

Admittedly, no law is perfect or is universally applicable regardless of the circumstances. We are all subject to the errors of being human. Therefore, if there are legitimate concerns with the bill, they can be considered in the coming weeks as the Massachusetts House debates the issue. Even if the bill is passed and signed by the Governor, the bill – as with most complex legislation – will need to have regulations drafted to implement its provisions, and public hearings will give people another opportunity for input. The facts are that those of us who are advocating responsible public health emergency preparedness are not acting out of any nefarious, “big brother” mentality, but out of a genuine concern for protecting the health and lives of all citizens without arbitrary restrictions on the rights of any one citizen. Debate on the issue should focus not on personal and slanderous attacks on individuals, but on the merits of the legislation. A debate on the merits and the substantive issues is another American right, outrageous personal attack against others is not a respected means of dissent – at least not up to now in America!

    The language of Senate bill #2028 does not define what an emergency is, except that it is an event that is “detrimental to the public health”. A level 6 pandemic level is based on infectivity and not virulence. Yes, people get infected very rapidly with H1N1 but the great majority of people recover without incident with much lower mortality than the seasonal influenza. However, the big problem is, that the classification of pandemic level 6 is enough to declare a state of emergency and impose state usurpation of basic freedoms. It contains language that can lead the state to mandate vaccination, seize property ,institute fines and imprison Americans for failure to comply. So basically they are saying they won’t do these things but meanwhile they are acquiring the power to do them. Very interesting and dangerous.
    Why are we making more laws that can be abused or misinterpreted when we already have law presidence on the books? Example if someone that has been diagnosed with AIDS/HIV and they knowingly spreads the disease to other people without their knowledge this person can be arrested and charged with existing criminal law. Politicians feel that in order to appeal to their constituents they must make more laws to allay unfounded concerns and at the same time grab more power from the people by, as this administration has so nicely put it as, not letting a crisis go to waste. We as Americans also are to blame because we allow baffoons to get into office and then get too hypnotized with American Idol to pay attention to our political process and the gradual loss of our liberties.

    The vaccine will cause debilitating and chronic symptoms or death to those with blood types A, B & O. These blood types have damaged DNA and weakened immune systems.

    The blood type AB is the normal healthy blood type with normal DNA and immune system.

    Good luck. Not one of my colleagues will take this shot. We never do with the standard flu, why would we now? The darn vaccine is worse than the flu. I asked the RN that was giving them if she was going to have one, and she just laughed and said “um no.”

    State Senator Richard T Moore, who authored the draconian S.2028 forced vaccination bill, doesn’t like to face tough questions from informed constituents. On Wednesday Moore successfully dodged a group of concerned parents, hiding out in his office for nearly an hour while his office clerks struggled to answer basic questions about his far-reaching legislation.

    Moore’s aides parroted the same lie that Moore himself has been telling the mainstream media: “This bill would NOT force vaccinations on anyone.” While this statement may be technically true, it omits the key fact that the bill would impose stiff fines and even imprisonment (quarantining) for people who refuse the vaccine. That means coercion would indeed be used against us if this bill passes.

    Another lie being spread by Moore and his staff is that they already have the power to force medical treatments on the public in an emergency anyway; and that all S.2028 would do is add “due process” to those existing laws. Trouble is, no one from Moore’s office was able on Wednesday to articulate which “due processes” are missing from the current laws.

    Given that Deval Patrick and his Beacon Hill gang actually believes they have the power to trample our basic constitutional right to choose our own medical treatments, the only “pandemic” bill that ought to be considered seriously by our representatives would be one that renders null and void any “laws” that supposedly give government the “right” to force-vaccinate.

    What’s evidently needed on Beacon Hill is a bill that reaffirms the definition of “inalienable.”

    Join us this Saturday in Uxbridge to demand the impeachment of Senator Richard T Moore, for his treachery against the state constitution and our basic human right to choose our own medical treatments.

This health care plan will be run entirely in the red, like most of govt. now is and long has been. This goes beyond fiscal irresponsibility; it is fiscal madness … unless that is, the plan is to break the country and subsume it into a global monopoly govt. … are these government suits just nuts… or are they smart like a fox….? BTW mandating that people have health insurance does not “expand access to affordable health insurance, and therefore health care”. It’s gunpoint disease care.

    Senator, the State has no right to attempt any of this. Remember you are not “Officials”, you are servants who take an oath to uphold the Constitution. What you seek to do goes far beyond the authority that is granted to you, no matter how “good” your intentions may be.

    You have no right to vaccinate anybody. You have no right to enter the premises of someone who has committed no crime. You have no right to take a sick person from their home. There are laws against assault. There are laws against battery. There are laws against kidnapping.

    In your proposal you recognize these crimes and civil offenses but you provide immunity from liability to the functionaries who would do your bidding.

    I will grant you that the State should be able to quarantine a person in his own domicile and perhaps may arrest the person should he venture out of quarantine and risk the public health. That’s as far as I would go.

    I am definitely pro-government, but my government was founded to protect the rights of all the citizens. You would be better suited for a position in China or Cuba.

    I just don’t trust the government… I guess I must have an ‘attitude problem.’ I guess those ‘Camp FEMAs’ my evil conspiracy theorist neighbor told me about are for people like me… people who have read that the NWO elites (in their own words)are just itching to reduce the global population … by several millions, actually. And last I heard, none of THEM was volunteering to set a good example and go first…

    Now this health care plan that that new handsome boy wonder Prez. is pushing so hard, I heard that there are elements of ‘triage’ somewhere in those thousand pages than none of those backing the legislation have bothered to read… meaning that, medical care might be denied to some… maybe your mom, your grandpa… but not to worry … they will be given ‘death counseling’… I think that’s what it’s called… maybe something fancier and nicer sounding….

    The fact that all this bothers me makes me ‘paranoid’ I guess …. and a ‘conspiracy theorist.’

    So now ‘my’(sic) government wants – maybe is going to FORCE – me and my kids to take these vaccines, with squalene (cause of Gulf War Illness, it turns out), and mercury, and formaldehyde,and aluminum, and live viruses in them… and these are just SOME of the things they ADMIT are in these ‘mystery shots’ of theirs. Gee, I sure HOPE the shots are safe… because I will have NO LEGAL RECOURSE if I or my kids are sickened, suffer permanent damage, or or are killed as a result of taking them… they already passed a special ‘law’ about that…

    But I guess I am a BAD person, because somehow all of this gives me a real hard time, and I am feeling like the sound and the picture are just not matching up here… I guess I better go and turn on that TV news and be told again, just exactly what to think about all this…

    It’s easy to see that Mr. Moore is a self serving moron, portraying any citizen who does not capitulate to the governments plans to foist their ideas and opinions on us as radicals. Listen up Mooreon, when the people are loud it is because our employees, those leaders who work for us, are turning their deaf ear to we their employer.

    I think the best way to fix this mess is to vote out, recall or impeach every politician who’s set themselves so high up on a pedestal that they can no longer hear us. VOTE THEM OUT so they can get real jobs and get back to their roots’

    Furthermore, since they won’t hear any talk of term limits for their jobs, how about we impose our own term limits on all of these self serving politicians, so that they’re removed from office before they get the chance to grow rich by giving our tax dollars away to those who didn’t earn it.

    The more I read of things like this police state being staged in MA, the more I become convinced that it’s all part of a bigger picture, and whether an influenza pandemic ever occurs or not the powers that be may use these plans against the people because they’ll already be established when a turmoil of any kind develops. If you’ve learned nothing else about the Demonicrats and the Obama administration you should’ve learned by now that they’re all about controlling the population. Besides Obama’s Marxist mentor Saul Alinsky, too many of Obama’s close associates were either communists, terrorists, anti-establishment, radicals or haters of the American way of life. For example; when you see Black Panther Party members, led by Muslim leader Malik Shabazz, standing outside of voting locations – openly brandishing weapons, and they’re not charged with any crime, you’d better know that the fox is running the hen house and you and justice are merely obstacles to be overcome.

    Okay, listen up, here’s a place where you’ll find stories that Lauer, Couric, CNN, or the NY Times won’t offer you. I’ll admit that there are some ‘out there’ stories on this website, but if you want to read stories related to this police state being proposed by MA and other states, I strongly suggest that you go to http://www.infowars.com. You’ll read about things such as spermicides and cosmetics found in H1N1 experimental vaccines, vaccines that some are talking about making mandatory. How can this be? What you may be unaware of is that vaccine makers were given protection from lawsuits by a bill passed GWBush. I’m sure Bush never envisioned things like this, but nevertheless this is where we are now. Read the articles and discern for yourself what is right or wrong.

    And the eternal excuse for all this is 9/11. When most people know now that the events of that day according to the official story are questionable and require an independent review and investigation. Denial and riducule is not working anymore. The dam is about to crack…..

    1.) CommonHealth is probably a paid government shill.

    2.) There is absolutely NO evidence for the use of this vaccine. There is a ton of evidence against it.

    3.) This is actually just another government bailout, paid for by the taxpayers… and given to the pharmaceutical industry.

    4.) Politicians either can’t read or they just don’t take the time to read the bills they pass. Fourth graders would do a better job of running this country, other than a few in the house.
