13:06 guest989315 Hi Guest 83689. I would suggest applying for insurance, either through MassHealth or Commonwealth Care, rather than initially apply for a waiver. You are much better off with insurance than without it.

13:18 Richard Powers, Health Connector Hi Rob B … you should get insurance by Nov. 15. That guarantees you will have coverage by Dec. 1. If you purchase after Nov. 15, your coverage probably won’t take effect until Jan. 1.

13:30 H Reform Groupy Harry, the penalties for 2008 (you pay in your April 2009 taxes) haven’t been set yet. The law says the penalites can be up to half the cost of the cheapest plan available to you. But they may be less.

13:31 marthabebinger Harry – for the 2008 year, the penalty will be half the cost of the lowest priced plan. There may be some adjustments to the penalty plan soon…we’ll post those on the blog when they are out.

13:31 guest748234 The penalties are in place in order to have the highest participation possible. The more people participate, the larger the risk pool, the lower the rates for everyone. Without penalties, people have not signed up.

    Hi Harry,

    All penalties will be levied through the Department of Revenue when you file your annual state tax returns.

    this whole program is a corporate gimmee masquerading as social welfare… we are being forced to pay a private insurance company for services we don’t necessarily use … my tax money is spent on an illegal war that lines the pockets of our corrupt “leaders”, rather than my health coverage… if these are the values of our society, then let the hospital turn me away so i can die in the gutter… this program is a complete scam, and my state government is regulating another ecomomic burden on the working class for the sake of private corporations… sure, its great if you have massive health problems, but i am fine not going to the doctor… like i said, if our society would rather support the murder of foreign people and not take care ofi ts citizens then please, turn me away and let me die in the gutter so i will not become a “burden” to the taxpayers… i don’t need it, i don’t want it, but now i will be punished for not handing over a significant portion of my weekly pay to a private corporation… another instance where the American citizens are very easily scammed… shame on Massachusetts… SOCIALIZED MEDICINE IS A HUMAN RIGHT IN A MORAL SOCIETY, AND WAR IS NOT!

    Citizens are telling you they cannot afford your insurance and you are all patting each other on the backs! Are you not from this planet? Are you that insensetive? The help line is broken,citizens are having nerveous breakdowns and all you can do is go into denial and say “great job”? when will you and the state house start realizing the truth? You do not have any affordable health care plans and only the poor and the wealthy will have health coverage.Are there any decent honest people working at Commonwealth connector or Health care for all? What a joke “Health care for all”start telling the truth because people are finding out for themselves.

    In response to Norma and “working poor” comments: Large numbers of people in the state are also being traumatized by this law. I feel terrible about this as do many other health professionals and citizens who understand the details.

    The state mailings and various ads about the mandate deadline and penalties do indeed come across as intimidation tactics – I suppose they are meant to, since this is a “stick” approach to force people to purchase a product or else get fined.

    While it feels very feeble and inadequate, I want to express to you and others my sincere apology for the creation of this misguided law.

    I also want to share the news that concerted efforts are being made to expose the deep flaws in this mandate plan and to stop it. There is a growing awareness among national elected officials and those here in the state that this is a costly and inhumane experiement that should stop before more harm is done.

    We can use the momentum of reform to re-chart the course of this law toward a more cost-effective, humane, and successful direction. State and national advocacy groups and legal organizations are working together toward this goal with growing intensity and coordination.

    A health reform forum next week at Rutgers University is national in scope and a number of the panelists and attendees will discuss these concerns and plan action to stop the flawed individual mandate plan from moving forward.

    It’s also encouraging that representatives in Governor Patrick’s office have told concerned callers that the Governor, too, has serious concerns about the mandate law. We need Governor Patrick to step up and act on those concerns.

    The first one tells someone who is living overseas to buy insurance in Massachusetts where the plans operate on the ‘preferred provider’ and ‘in network’ criteria.’ Real NOT useful to someone living in another country.

    The second one flat lies when he says “insurance is cheaper than medical bills.” Uh huh. Over 50 you get hit at minimum with $350 a month in premiums PLUS a $2000 deductible but no drug coverage and , heaven help a couple over 50 – it is $700 a month PLUS a $4000 deductible and no drug coverage. Not many people have medical bills in excess of $6200 for one person or $12,400 for a couple. Even for someone in that magic group that has the lowest comprehensive premiums of $175 with a $2000 deductible but no prescription coverage would have to have medical bills in excess of $4100 before they derive any benefit from supporting the insurance companies profit line.

    I have been trying to tell the Governor the lawmakers at Beacon Hill,the Commonwealth Connector and Health care for all, people aren’t signing up because THEY CAN”T AFFORD THE INSURANCE!     $219.oo is the fine for not having insurance by the Dec. 31rst dedline. Or so I’m told -> (1-877-623-6765). Why bother paying that when health insurance costs you so much more? Well according to 1-877-MA-ENROL the government is going to be penalizing us $219.00 each and every month we don’t have health insurance.

    So you get “fined” $219.oo a month and still end up with no coverage. Hey at least you will be able to put food on your table and make your mortage payments.

    I am so freaking happy I waited to buy a house. I was in love with that house and thankfully my brother talked me into waiting. I would’ve had a mortgage payment of $1800.oo a month. That wouldn’t be so bad with this new law except that I’m a sub contractor.

    If I bought that house I would have to remortgage my property just to stay afloat. I’m sorry, but there is absolutely no way possible everyone in MA can afford or even come close to affording health insurance.

    I will be leaving the state of MA within a year because of this new law. The only other options I currently have is to spend the rest of my life living in an apartment or maybe finding a condo and selling it years later down the road. That and finding a new profession…

    These lawmakers need a good kick in the a$$!

    MikeyA – the confusion might have come from someone at the connector contraption (just another layer of wasteful bureaucracy that wastes precious healthcare dollars, imho)trying to explain how the fines will increase steeply next year.

    Starting in 2008 the MA government plans to come after people who have not purchased an insurance product deemed “affordable” by the connector contraption and fine them every month that they did not buy insurance. The fine amount depends on your age, your income, where you live, and the precise amount will be half the premium price of the least expensive insurance product available to that person.

    Anybody would be confused trying to figure out this overly complicated and misguided law.

    I’m planning on challenging this law “pro se” sometime next year. But I have corresponded with a lawyer referred to me by the Cato Institute, he is willing to take the case and has some good experience with challenging state laws, but will understandably not do it pro bono.

    Martha Bebinger left me a voicemail last week saying that she was getting a lot of inquiries about how people can challenge this law. Unless there is something else afoot that I am not aware of, then I would suggest you go to the website I set up: http://www.fairhealth.org and sign up for the mailing list. If you would be interested in helping fund a legal challenge, then contact me at fairhealth@gmail.com so I can gauge interest. I’d say if a thousand people could chip in $100, (or if 10,000 people will pledge $10… or somewhere in between) then about one hundred thousand dollars should be able to pay for a proper legal challenge and be much more likely to succeed than my pro se efforts. At this point, I’d just be looking for pledges and contact information, because I have not yet created the needed organization around this. Also, if anyone would like to help organize or publicize this effort, then let me know.

    I do have quite a bit on my plate and I wasn’t looking to take on another cause, but I will do what I can since there are many people hurt and inappropriately burdened by this law, but few people are able to stand up for themselves against irresponsible politicians and businessmen.

    I can’t promise that we can overcome the political inclinations of what are supposed to be independent judges, but my hope is that we can convince this progressive Supreme Judicial Court that this law amounts to an illegal regressive taxation on income or an illegal fee.

    It would be much better to resolve this through the legislature, but it seems that an insurmountable number of incumbent politicians are hell bent on “experimenting” with this approach despite its obvious inequity and unfairness. The Democratic Party is clearly in control on this issue in Massachusetts and is going to great lengths to keep its party members in line and from thinking for themselves.

    Which I find tragic, because this is clearly a law that goes against everything that both the Democratic and Republican Parties have traditionally believed in as the basis for responsible public policy. I don’t think this single issue can engender a “throw the bums out” revolution because the burden of this public policy has been disproportionately placed on a minority of middle income people, but combined with the looming threat of ever greater tax increases I think this could be one issue among others that drives our state towards a return to responsible governance.

    As for your personal decision, it will likely take a couple years to get through the courts, so people are better off making their own choices as to how this will effect them with no expectations that they will get their fines refunded at the end of this looming court battle.

    Also, as much as I admire what Ann Malone is trying to do, I think our approach is different. defendhealth.org is trying to push an agenda, one which I may partially agree with, but what I am trying to do is simply to enforce a principle of fairness and justice in government. So, I could see either a free market health care reform or government paid for health care being acceptable ways of promoting the common good. But I do not see what Massachusetts has created as some sort of grand compromise or middle path between these two approaches, but rather a compromise and corruption of the principle of good government itself. I do not seek to replace the health care reform Massachusetts has created with anything in particular, I simply wish to destroy it because of its inherent evil. I will work with and for any group working towards that end.

    Anyway, please sign up for the email list because regardless of how I myself decide to move forward, then it will still be a step forward to have a group of people who are passionate, in their opposition to this type of irresponsible government mandate, being able to more effectively organize themselves through greater collaboration.

    I appreciate your time and effort on this issue as well. But if we do not work to replace this bad health insurance mandate law with good health policy won’t we likely end up, again and again, in a stuation like we are in now?

    I’ll readily acknowledge that Ann Malone and the Alliance to Defend Health Care have a larger agenda than simply stopping this harmful and wasteful mandate law.

    The Alliance’s “agenda” is to enact health reforms that clearly move us toward a sustainable program (one that could have public and private insurance components) that is not profit-driven and that guarantees affordable quality care for everyone.
